When Is Tyler Robinson's Trial? No Date Yet in the Charlie Kirk Case

Status as of Oct. 24, 2026, 12:00 PM PT. Court dates can change. Check our Court Calendar and its “last updated” date.

There is no trial date yet in the Charlie Kirk case. Tyler Robinson is charged in Kirk’s shooting death. At a hearing on Oct. 23, 2026, the judge heard three very different plans. He did not pick one. He set Monday, Nov. 9, 2026, to rule on a trial schedule. [1][2]

Robinson, 23, has pleaded not guilty. He is presumed innocent. [4]

Who was Charlie Kirk?

Charlie Kirk was the husband of Erika Kirk and the father of two young children. He was a co-founder of Turning Point USA. He was shot and killed on Sept. 10, 2025, while speaking at Utah Valley University. [1][7][8]

Some reports call him the founder of Turning Point USA. Others say co-founder. We use “co-founder,” which fits both reports.

Has a trial date been set?

No. Judge Tony Graf heard arguments on Oct. 23 but did not set a date. [1][2] He said: “I am not going to run back into my office and type quickly and kick something out.” [1]

He set Nov. 9, 2026, to rule on a trial schedule. FOX 13 reports the lawyers return to court that day at 1 p.m. Mountain time. Only one outlet has reported that time, so treat it as tentative. A trial date may not be set that day. [2]

When could the trial start?

Three sides gave three plans. None of them is a set date. [1][2][3]

Who askedWhat they asked for
ProsecutorsStart Jan. 31, 2028. The trial would last about 17 weeks. They said they could be ready by Oct. 4, 2027.
The defenseThe third quarter of 2029. The trial would last six to seven months.
Erika Kirk’s lawyerOctober 2027.

Why does the defense want 2029?

The defense says it needs time to go through very large evidence files. It also points to a mitigation investigation (gathering facts about a defendant’s life that could matter at sentencing), jury selection and a possible study of whether the trial should move to another county. [1][2]

No request to move the trial has been filed, as far as public reports show.

What did Erika Kirk ask for?

Erika Kirk’s lawyer asked for a trial in October 2027. The lawyer pointed to Utah’s victims’ right to a “speedy disposition,” which means a prompt end to the case. [1][2][7]

What is Tyler Robinson charged with?

Robinson is charged with seven counts. The most serious is aggravated murder. [4]

Prosecutors allege “aggravating circumstances.” These include that the victim was targeted. These are claims. A jury has not decided them. [4]

Reports differ on how Utah labels the aggravated murder count. One says “first-degree felony.” Another says “capital felony.” We have not read the charging paper, so we do not settle that here.

Did he plead guilty?

No. He pleaded not guilty to each count on Sept. 1, 2026. He is presumed innocent. There has been no trial, no verdict and no sentence. [4]

What does “bound over” mean?

On Sept. 1, 2026, a judge bound Robinson over for trial on all seven counts. [4]

“Bound over” means a judge found there is enough evidence for the case to go to trial. It is a step in the process. That ruling is not a finding of guilt.

Is this a death penalty case?

Prosecutors are seeking the death penalty. On June 26, 2026, the judge ruled that the death penalty stays available as an option. [5] No one can know the outcome. A jury has not heard the case.

Is there a gag order?

Yes, for the lawyers. A court order limits what the lawyers can say in public about the case. It does not bind the news media. [5][6]

On June 26, 2026, the judge held a deputy county attorney in civil contempt for a public comment about the evidence. [5]

Will the trial be on TV?

The judge allowed cameras at the preliminary hearing in July 2026. [9] Camera rules for the trial itself are not known from public records.

What happens next?

  • Nov. 9, 2026: the judge plans to rule on a trial schedule. The 1 p.m. time is tentative. A trial date may not be set that day. [1][2]
  • Whether the judge will rule before Nov. 9 is not known.
  • After a schedule is set, more pretrial steps are likely, such as jury selection and the venue question. (Theory: this is our reading of the defense’s stated plans, not a court order.)

What is still not known?

  • The trial date.
  • The confirmed time on Nov. 9.
  • The state case number. We have not checked it against a court record.
  • The felony label on the aggravated murder count.
  • Whether cameras will be allowed at trial.
  • What the defense will argue at trial.
